Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Rele Pty Ltd ("Rele", "we", "our", or "us"), governing your access to and use of the Rele real estate platform, including our website, mobile applications, and all related services (collectively, the "Services").

By accessing or using our Services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are accessing the Services on behalf of a company, organisation, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

If you do not agree to any part of these Terms, you must immediately discontinue your use of the Services. We reserve the right to update or modify these Terms at any time. Continued use of the Services after any changes constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or a prominent notice on the platform.

To access certain features of the Services, you must register for an account. When creating your account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must promptly notify us of any unauthorised use of your account or any other breach of security by contacting us at info@rele.one. Rele will not be liable for any loss or damage arising from your failure to safeguard your login credentials.

You may not transfer your account to another person or entity. Each user may maintain only one active account, except where explicit permission is granted by Rele in writing. Accounts registered using automated means or under false pretences will be terminated without notice.

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, including where we suspect fraudulent activity, violation of these Terms, or conduct that may harm other users or third parties.

Rele provides a platform for the listing, browsing, and inquiry of real estate properties across Australia. All property listings submitted to the platform must comply with applicable Australian laws, including the relevant state-based property sales legislation, anti-discrimination laws, and fair trading regulations.

By submitting a property listing, you represent and warrant that you have the legal right and authority to list the property, that all information provided is accurate and not misleading, and that the listing does not infringe upon any third-party rights. Rele does not verify the accuracy of listing information and accepts no responsibility for errors, omissions, or misrepresentations in any listing.

Rele reserves the right, without obligation, to remove or modify any listing that we determine, in our sole discretion, violates these Terms, applicable law, or community standards. This includes, but is not limited to, listings that are duplicated, fraudulent, discriminatory, or contain inappropriate content.

Any transactions or negotiations arising from property listings are conducted directly between the parties involved. Rele is not a party to any real estate transaction and accepts no liability for the outcome of any deal, agreement, or dispute between users.

The Rele.one platform, including all content, features, design elements, trademarks, service marks, logos, and software, is the exclusive property of Rele Pty Ltd and is protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, or exploit any part of the Services without our prior written consent.

By submitting content to the platform - including property descriptions, images, reviews, and communications - you grant Rele a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and distribute that content for the purpose of operating and improving the Services. You retain ownership of your content but represent that you have the right to grant this licence.

To the maximum extent permitted by applicable law, Rele and its officers, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities arising out of or in connection with your use of the Services.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Rele does not warrant that the Services will be uninterrupted, error-free, or free from viruses or other harmful components.

Where liability cannot be excluded by law, including under the Australian Consumer Law, Rele's total cumulative liability to you for any claim arising from or related to the Services shall not exceed the greater of AUD $100 or the total amount paid by you to Rele in the twelve months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

You may terminate your account at any time by contacting us at info@rele.one or by using the account deletion option available in your account settings. Upon termination, your right to access and use the Services will immediately cease.

Rele reserves the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, conduct harmful to other users or the platform, or inactivity exceeding 24 months.

Upon termination, Rele may retain your data in accordance with our Privacy Policy and applicable data retention obligations. Sections of these Terms that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, limitation of liability, and governing law.

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions. You agree that any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Rele with respect to the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.
